1 PURPOSE AND SERVICES
1.1 The Services are provided by Lifehak Enterprises Limited, t/a HomeHak.com with company number 640453 and registered office at Springvale, Broghill, Charleville, Cork, Ireland P56 HH63, Ireland (“HomeHak” “we”, “our” or “us”).
1.2 This HomeHak Privacy Notice (“Privacy Notice”) aims to make you aware of how and why we collect, use and process your personal data, who we share it with, and your legal rights as a user of our Services. We encourage you to read this Privacy Notice, together with our Cookie Policy before using our Services.
1.3 Our Services make it easier for tenants looking for rental accommodation to provide their credentials and connect them with landlords and agents to show their suitability for a property and to help all users of the platform to communicate on the platform. As part of our Services (which may evolve from time to time), tenants may do the following:
1.1.1 submit a HomeHak tenant CV to landlords and agents on property websites; or
1.1.2 upload and store information on HomeHak related to your home search;
1.1.3 create a professional Tenant CV to show your suitability for a property;
1.1.4 search our HomeHak platform for properties in a specific location;
1.1.5 contact Tenants, Landlords or Agents about a particular rental property;
1.1.6 contact other Tenants about joining as co-applicants;
1.1.7 verify your credentials by using our ID verification process;
1.1.8 invite people to view your tenant cv, a property or other information on the HomeHak platform by sending a link on social media, email or other channels;
1.1.9 invite people to view a property on the HomeHak platform by sending a link on social media, email or other channels;
1.1.10 invite people to provide you with a reference;
1.1.11 provide references to other people;
1.1.12 review information about locations and businesses in the HomeHak Local Guides;
1.1.13 review information in the HomeHak blog and other pages intended to provide helpful information;
1.1.14 upload or download or copy portions of information, data, text, sound, images, photographs, graphics, video, messages and other materials for the purposes of finding rental accommodation; and
1.1.15 view third party material and send and receive messages between you and Tenants, Landlords, Agents and Reference Providers on our Services.
2 DEFINITIONS
2.1 In this Privacy Notice:
“Agent” means an individual professional or consultant who is appointed on behalf of a landlord to find a tenant for their property when they are using the HomeHak platform;
“Landlord” means a company or organisation, or an individual, professional or consultant, that has a Landlord account and is offering accommodation for rent when they are using the HomeHak platform;
“Services” means the HomeHak platform, the website located at https://homehak.com/ and any subdomains of the website, any content and materials on our platform and website, and any other software, products, services, information, tools and technology that we make available to users;
“Tenant” means an individual or entity that has a Tenant account on the Services;
“User” means a user of the Services;
2.2. When we use the terms ‘personal data’, ‘controller’, ‘processor’ and ‘special categories of personal data’, those terms have the meaning given to them in the EU General Data Protection Regulation (“GDPR”).
3 DATA CONTROLLER- INFORMATION FOR TENANTS
3.1 When we are a controller: We are the controller of the personal data you upload on your Tenant CV and any posts on your Tenant account profile. However, we will not further process the data you upload to your Tenant account beyond the provision of the Services unless: (a) you ask us to do so; (b) applicable law requires us to; or (c) as otherwise set out in this Privacy Notice.
3.2 When a Landlord or an Agent is the controller: If you use our Services to create a Tenant CV to send to a Landlord or Agent, directly or using a property website, the Landlord or Agent is an independent controller of this information. In addition, we do not influence how the Landlord or Agent uses the information that you have set out in your Tenant CV on the HomeHak platform and the Landlord or Agent acts as an independent controller of this information upon receipt of it. You should communicate directly with the Landlord and/or Agent (as applicable) about their processing activities and retention policy in respect of any personal data which you provide to through the HomeHak platform.
4 DATA CONTROLLER- INFORMATION FOR LANDLORDS AND AGENTS
4.1 When we are a controller. To become a Landlord and use the Services you have to create a Landlord account on the Services. We are the controller of the Landlord account profile data (for example, name, user ID, password and other account registration details) that you upload on the HomeHak platform.
4.2 When a Landlord is a controller: We are not responsible for how you handle the personal data that a Tenant sends to you using the Services, including information which resides in the Landlord’s account on the HomeHak platform. As the controller of this information, you are responsible for compliance with all applicable data protection laws, including providing privacy notices to Tenants, obtaining necessary consents for the processing of Tenant personal data (where relevant) and complying with data subject requests from Tenants (for example, access, correction and erasure requests).
4.3 When an Agent is a controller: We are not responsible for how you handle the personal data that a Tenant sends to you while using the Services, including information which resides in the Agent’s account on the HomeHak platform. You are responsible for compliance with all applicable data protection laws either in your own capacity as a controller or, if you are acting on behalf of a Landlord, in their capacity as a controller, including providing privacy notice to Tenants, obtaining necessary consents for the processing of Tenant personal data (where relevant) and complying with data subject requests from Tenants (for example, access, correction and erasure requests).
5 TYPES OF PERSONAL DATA WE PROCESS
5.1 Visitors: Anyone can generally visit our website without identifying themselves. Please note that we will collect and process:
5.1.1 usage and troubleshooting information;
5.1.2 IP address;
5.1.3 information about your device;
5.1.4 information about your web browser;
5.1.5 information about your internet activity using cookies;
5.2 Tenants: If you are a Tenant and you create a HomeHak Tenant CV and/or sign up for an account on the HomeHak platform, we may collect and process certain personal data about you, including but not limited to:
5.2.1 account profile data (your name, email address, username and password for your account);
5.2.2 contact information such as your home address and mobile phone number;
5.2.3 date of birth, age and gender;
5.2.4 information relating to accommodation preferences;
5.2.5 interests and hobbies;
5.2.6 employment information and references;
5.2.7 previous landlord references;
5.2.8 images and video files that you upload to the HomeHak platform for ID verification purposes or other specified purposes;
5.2.9 location information device-based settings (such as access to GPS location, camera and microphone) which determine your real-time location to enable the Services to match you with a property in your chosen location;
5.2.10 usage and troubleshooting information such as your device model, Operating system, IP address and details of when you have logged in and how you have used your account (e.g. the fact that you have opened and read a message from a Landlord);
5.2.11 any other information which you or a third party post or upload to your account; and
5.2.12 special categories of personal data including:
· data concerning health; and
· data concerning a natural person’s sex life or sexual orientation.
5.3 Landlords: If you are a Landlord and you sign-up for the HomeHak platform, we may collect and process certain personal data about you:
5.3.1 account profile data (your name, email address, username and password for your account);
5.3.2 contact information such as your home address or business address (if applicable) and mobile phone number;
5.3.3 date of birth, age and gender;
5.3.4 images that you upload to the HomeHak platform for ID verification purposes;
5.3.5 usage and troubleshooting information such as your device model, Operating system, IP address and details of when you have logged in and how you have used your account;
5.3.6 any other information which you or a third party post or upload to your account.
5.4 Agents: If you are an Agent and you sign up for the HomeHak platform, we may collect and process certain personal data about you:
5.4.1 account profile data (your name, email address, username and password for your account);
5.4.2 contact information such as your business address and business phone number;
5.4.3 usage and troubleshooting information such as your device model, Operating system, IP address and details of when you have logged in and how you have used your account (e.g. the fact that you have opened and read a message from a Landlord);
5.4.4 any other information which you or a third party post or upload to your account.
5.5 Reference Providers: If you are a Reference Provider and you sign up for the HomeHak platform, we may collect and process certain personal data about you:
5.5.1 account profile data (your name, email address, username and password for your account);
5.5.2 contact information such as your business address and business phone number;
5.5.3 usage and troubleshooting information such as your device model, Operating system, IP address and details of when you have logged in and how you have used your account (e.g. the fact that you have opened and read a message from a Landlord or a Tenant);
5.5.4 any other information which you or a third party post or upload to your account.
5.6 Third parties: We may obtain personal data about Users from our third party providers and publicly available sources such as our payment processing providers, analytics providers, advertising networks and search information providers.
6 WHY WE USE PERSONAL DATA
6.1 We will collect and use the above personal data for the purposes outlined below and we rely on the indicated separate and overlapping legal bases to lawfully process personal data.
6.2 We may process personal data for more than one lawful ground depending on the specific purpose for which we are using that data. We only use your personal data for the purposes for which we collected it, unless we believe that we need to use that personal data for another reason that is compatible with the original purpose or as applicable law permits. If we intend to your process personal data for an unrelated purpose, prior to that processing we will explain the legal basis that allows us to do so.
6.3 The table below sets out the purposes for which we use your personal data and the legal bases we are relying on:
To provide Tenants, Landlords and Agents with our Services to help customise and improve the experience of matching properties for rent to the needs of tenants and to allow Tenants to communicate efficiently with Landlords, Agents, other Tenants and Reference Providers. Lawful basis - Our legitimate interest in delivering our Services to our Users.
Necessary to perform a contract we have with Tenants, Landlords and Agents pursuant to our Terms of Use.
Developing new functionality and features. Lawful basis - Our legitimate interest in developing User insights and improving our Services and our business.
To allow us to understand the activity of Users on our Services. Lawful basis - Perform analytics on our Services for our legitimate interests to optimise the performance of our Services and improve and develop relevant features.
To allow Landlords and Agents to share and advertise properties on the HomeHak platform. Lawful basis - Necessary to perform a contract we have with Tenants, Landlords and Agents pursuant to our Terms of Use.
To enforce our legal rights and obligations. Lawful basis - Our legitimate interest in detecting and defending against fraudulent, abusive or unlawful activity in order to keep our Services safe and secure.
7 SHARING OF PERSONAL DATA
7.1 We will share the personal data (described in clause 5) with:
7.1.1 Landlords and Agents (if you are a tenant);
7.1.2 Tenants (if you are a Landlord or Agent);
7.1.3 Reference Provider;
7.1.4 Third Party Service Providers for example, customer support providers and advertising networks;
7.1.5 Analytics Partners;
7.1.6 Technology service providers who help us operate and support the functionality of the HomeHak platform, including data hosting providers and IT service providers;
7.1.7 Social media channels for the purposes of promoting a Tenant’s CV to other persons;
7.1.8 Our professional advisors, including lawyers, auditors and insurers;
7.1.9 Possible acquirers or investors (and our and their advisors) in the context of facilitating or implementing a business reconfiguration or reorganisation or a transfer or sale of all or part of our assets or business, including, but not limited to a divestiture, acquisition or business reconfiguration. Alternatively, we may seek to acquire other businesses or merge with them; and
7.1.10 Regulators and law enforcement organisations if we are required to do so to meet relevant legal and regulatory obligations.
8 SECURITY
We take the security of your personal data very seriously. We have put in place appropriate technical and organisational measures to protect against accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to personal data. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
9 TRANSFERS OF PERSONAL DATA
In some cases, we need to transfer your information to recipients outside the European Economic Area (“EEA”) who are located in countries that do not have equivalent data protection laws. Where we transfer your information, we do so in accordance with EU data protection law. We utilise standard contractual clauses approved by the European Commission which apply appropriate warranties and safeguards to preserve your privacy where your data is transferred.
10 DATA RETENTION
We will only retain your personal data for as long as is necessary for the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax and accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect of our relationship with you.
To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.
For example, when you create a HomeHak account, after the free trial period ends, you will be given the option of choosing how we retain your personal data. If you don’t choose, your account will be dormant and we will retain your personal data for 12 months.
11 LEGAL RIGHTS
11.1 You have certain rights as a data subject in relation to your information. While some of these rights are general and unrestricted, other rights only apply in certain circumstances.
11.2 Your rights include:
11.2.1 access- you are entitled to obtain a copy of the personal information which we hold about you and certain additional details regarding how we process your personal information, subject to any legal restrictions.
11.2.2 rectification – you can request rectification of your personal information if it is inaccurate or incomplete.
11.2.3 restriction – you can restrict our use of your personal information.
11.2.4 deletion – you are entitled to request that we erase your personal information.
11.2.5 objection – you can object to the processing of your personal information where our legal basis for processing your data is our legitimate interests.
11.2.6 portability – you can request a copy of personal information you provided to us to be transferred, subject to certain exceptions provided by law.
These rights may be restricted in certain circumstances such as, for instance, where they may be needed to comply with our legal obligations or for the establishment, defence or exercise of legal claims.
A data subject can make these requests by writing to us at support@homehak.com or alternatively can review, edit and or delete their information through your account profile settings.
If you do not think that we have processed your personal information in accordance with this notice or the GDPR, please contact us in the first instance. You can alternatively complain to the Data Protection Commission (“DPC”) or exercise any of your other rights pursuant to data protection law. Information about how to do this is available on the DPC website at www.dataprotection.ie.
12 THIRD PARTY SERVICES
The HomeHak platform may contain links to other websites and services, which are managed and controlled by third parties. This Privacy Notice does not apply in those cases and we are not responsible for the privacy practices of such third parties.
13 COOKIES
We use cookies and related technology on HomeHak. In relation to limiting or disabling tracking technology, please see the Cookie Preferences and opt-out mechanism in our Cookie Declaration
.You may also be provided with preference questions or preference boxes allowing you to indicate that you do not want the HomeHak platform to use tracking technologies, such as cookies to “remember” your personal data, such as usernames or mailing addresses, on return visits. However, where the HomeHak platform uses tracking technologies to collect unidentified information, we do not generally provide you with the ability to opt-out of the tracking technologies. Some Internet browsers allow you to limit or disable the use of tracking technologies that collect unidentified information, such as a “Do Not Track” (“DNT”) setting.
14 CHANGES TO THIS PRIVACY NOTICE
We may update our Privacy Notice from time to time. The latest version of this Privacy Notice is always accessible on our app and website.We will let Users know about any significant changes by notifying them through our app or website and give you the opportunity to review them before any changes take effect.
